In the wake of California's AB2222 (California's version of the ADA), it is more important than ever to make disabled employees part of the reasonable-accommodation process. Now, failure to engage the disabled employee in the interactive process to determine possible accommodation can lead to a separate cause of action. Employers can "win the battle" by being right about possible accommodation but "lose the war" because they fail to allow the employee to have input into that determination. And, of course, because this is a California antidiscrimination statute, any win by the employee triggers attorney-fees exposure. Discover how to avoid costly ADA/FEHA violations.
